CHAPTER 2-22- DEPARTMENT OF LANGUAGE AND CULTURE

SUBCHAPTER A GENERAL PROVISIONS
Section 10 Purpose (2 PYTC § 2-22-10)
The purpose of this chapter is to establish the Pascua Yaqui Tribe’s Department of Language and Culture and to provide authorization and guidance for its operation.
Section 20 Short Title; Codification (2 PYTC § 2-22-22)

This ordinance shall be known as the “Pascua Yaqui Language and Culture Ordinance of 2218.”

This Ordinance shall be codified at Title 2, Part II, Chapter 2-22 in the Pascua Yaqui Code.
Section 30 Establishment (2 PYTC §2-22-30)
The Department of Language and Culture is hereby created as a Department in the Executive Branch of the Pascua Yaqui Tribe.
Section 40 Purpose of Department (2 PYTC §2-22-40)
Itom Hiak Lutu’uria Yooriwa into Nakwa
The purpose of the Department of Language and Culture is to preserve and protect the language, culture, history, and traditional arts of the Yaqui people, and to provide for the transmission of the culture, language, history and traditional arts to future generations of Yaqui.
Section 50 Mission (2 PYTC § 2-22-50)
Yora’ata itou To’osahaka’u
The mission of the Department of Language and Culture to preserve and protect the language, culture, history, and traditional arts of the Yaqui people through education, sponsorship of language, cultural, and historical research, review of outside research requested, and the coordination and assistance to federal, state, county, municipal, and tribal governments and departments regarding the Yaqui culture, language, history and traditional arts.
SUBCHAPTER B DIRECTOR
Section 60 Creation and Appointment (2 PYTC § 2-22-60)

The position of Director of Language and Culture is hereby created.

The Director shall not be deemed to be a “tribal officer” as defined in Article VII of the Constitution of the Pascua Yaqui Tribe; and

The Director shall be nominated by the Chairperson and must be approved by the Tribal Council by majority vote (no less than six votes) of the entire Council. Approval by the Tribal Council will constitute appointment to the position of Director.

The Director will be a full-time employee of the Tribe and will be paid compensation commensurate with his or her skills, education, experience, and responsibilities within the standards of compensation, if any, established by the Tribe.

The Director must report to, and will be directly supervised by, the Chairperson.

The Director serves at the pleasure of the Tribal Council, and may be removed from that position only by a majority vote (no less than six votes) of the entire Tribal Council.
Section 70 General Duties of Director (2 PYTC § 2-22-70)

The Director will administer, supervise and direct the activities of the Department of Language and Culture.

The Director will advise the Chairperson and Council with respect to:

Establishment of, and conformance with, policies and procedures of the Department;

The programs administered by the Department;
-
External legislation and regulation effecting the Department’s operations’
-
Inventory and appropriate use of materials and infrastructure;

Assurance that the personnel policies and procedures are accurately and fairly applied in all matters as it pertains to personnel management and administration’ and
-
Recommendations on all matters concerning the Department’s purposes, objectives, and programs.

Section 80 Supervisory Duties and Authorities of Director (2 PYTC § 2-22-80)

The Director has authority to select, appoint, and hire employees necessary to carry out the laws, regulations, policies and programs adopted by the Tribal Council including, but not limited to;
-
Hiring authority, subject to the policies and procedures of the Tribe’s Employees Handbook and Personnel policies;

Terminations authority, subject to the policies and procedures of the Tribe’s Employee Handbook and Personnel policies;
-
Personnel discipline;
-
Personnel performance review; and;
-
Personnel job assignments;

The Director has authority to delegate any function, powers, and authorities to other employees of the Department, except as may be prohibited by Tribal law.

The Director has budgetary authority for the Department.

The Director has authority to develop and implement internal policies for the efficient and effective administration of the Department.

The Director has signature authority for the Department, except as may be permissibly delegated.
SUBCHAPTER C ORGANIZATION
Section 90 Organization (2 PYTC § 2-22-90)

The Department consists of a Director and such departments and offices necessary for the execution of its mission, performance of its mandated functions, and to achieve its long and short term goals and objects.

The Department may employ staff professionals, support personnel, and/or contract with professional service firms as the Director determines, consistent with the laws of the Tribe and approved budgetary authority.

The Department must maintain a current organizational chart. The organizational chart must accompany its annual budget submission and any budget modification requests during the fiscal year, in accordance with the Tribe’s Fiscal Management Ordinance.
SUBCHAPTER D AUTHORIZED PROGRAMS
Section 100 Authorized Programs (2 PYTC § 2-22-100)

The Department will have Administrative Responsibility for the following authorized programs, and such other programs as the Tribal Council or the Chairperson may establish and assign.

Hiah Noki-Language Program- programs designed to preserve, expand and pass on to future generations the use of Yaqui Language through community classes, workshops, presentations, the translation of text, study, and consultation on Yaqui language curriculum.

Hiak Etehori-Culture- program designed to preserve, expand and pass on to future generations the culture of the Yaqui through community classes, workshops, presentation, research, and consultation on Yaqui cultural curriculum.

Hiak Lutu’uria-History- program designed to preserve, expand and pass on to future generations the history of the Yaqui through community classes, workshops, presentation, research, and consultation on Yaqui history curriculum.

Itom Sauwa’u- Traditional Arts- programs designed to preserve, expand and pass on to future generations the traditional arts especially to tribal members seeking to participate in Yaqui ceremonies through classes, workshops, presentation, and assistance in acquiring materials and constructing ceremonial regalia for participating members.

Point of Contact- if requested, the Department may be designated a point of contact and assist in the coordination of services among state, county, city, and tribal police and emergency responders during Yaqui ceremonies.

All programs authorized by the Tribal Council may be terminated by the Tribal Council at any time by a majority vote (no less than six votes) of the Tribal Council, and such termination shall act as a revision to this Chapter.

If the program listed in Subsection 1 (A) of this Section is not funded, the Department is authorized to create a plan for its implementation with an associated proposed budget for Tribal Council consideration. Once a program is funded, the Director shall create program goals and objectives.
Section 110 Office of Language (2 PYTC § 2-22-110)
The Department of Language and Culture shall serve as the Pascua Yaqui Tribe’s official authority on Yaqui language spelling and grammar. All Departments and Programs shall submit questions regarding spelling in the Yaqui language to the Language and Culture Department for advice and guidance. The Department’s determination of the correct spelling and grammatical use of Yaqui language shall be thereafter used by all Pascua Yaqui Department and Programs.
SUBCHAPTER E PROGRAM EVALUATION MONITORING
Section 120 Program Evaluation and Monitoring (2 PYTC § 2-22-120)

The Director must conduct ongoing evaluation of all programs under his or her control.

The Director must monitor all programs under his or her control on a regular basis.

In the event the Director discovers any irregularity in a program under his or her control, he or she must report that irregularity immediately to the Chairperson.

Section 130 Reporting (2 PYTC §2-22-130)

The Director will provide reports and meet with the Chairperson and the Tribal Council on the Department’s operations and significant activities on a regular basis.

The Director must report to the Council on programs under his or her control on a schedule determined by the Tribal Council.
