SUBCHAPTER A GENERAL PROVISIONS

Section 10 Definitions (S PYTC § 6-6-10)

In this Chapter, unless the context otherwise requires:

  1. “Boxing” means the act of attack and defense with the fists, using padded gloves that, is practiced as a sport. Where applicable, boxing includes kickboxing.
  2. “Boxing contest” means any boxing contest, match or exhibition.
  3. “Chairman” means the Chairman of the Pascua Yaqui Tribal Council.
  4. “Commission” means the Pascua Yaqui Athletic Commission.
  5. “Fraternal benefit society” means a society, order or supreme lodge without capital stock, including an incorporated or unincorporated society, that is conducted solely for the benefit of its members and their beneficiaries, is not for profit, operates on a lodge system with ritualistic traditions, and has a representative form of government.
  6. “Kick boxing” means forms of boxing in which blows are delivered with any part of the arm below the shoulder, including the hand, and any part of the leg below the hip, including the foot.
  7. “Mixed Martial Arts” is full-contact combat sport that allows striking and grappling, both standing and on the ground, using techniques from other combat sports and martial arts
  8. “Person” means any corporate body, partnership, or other entity organized for the conduct of business, as well as any individual.
  9. “Professional” means any person who competes for any money prize or a prize that exceeds the value of $35 or teaches or pursues or assists in the practice of boxing as a means of obtaining a livelihood or pecuniary gain.
  10. “Reservation” means all lands over which the Pascua Yaqui Tribe may exercise governmental jurisdiction.

Section 20 Application of this Chapter; Definition (8 PYTC § 6-6-20)

  1. The Pascua Yaqui Athletic Commission Regulations, as they relate to professional boxers, apply to amateur boxers, professional mixed martial arts athletes, amateur mixed martial arts athletes, promoters, matchmakers, and other licensees, except as otherwise provided.
  2. This chapter does not apply to any amateur boxing contest conducted by or participated in by the following institutions or organizations:
    1. Any school, community college, college or university or an association or organization composed exclusively of schools, community colleges, colleges or universities when each contestant is a student enrolled in a school, community college, college or university. As used in this section, “school, community college, college or university” means every school, community college, college or university and every other school, community college, college or university maintained primarily for the giving of general academic education.
    2. A government unit or agency of the Pascua Yaqui Tribe, the United States or the State of Arizona.
    3. A nonprofit association which has standards and regulations for the physical safety of the participants at least equal to the requirements of this chapter, including such bona fide amateur associations or organizations.
    4. A fraternal benefit society.
    5. Any bona fide private school whose primary purpose is instruction in the martial arts provided that the contests held in conjunction with such instruction are amateur.

Section 30 Regulation of Boxing Contests (8 PYTC § 6-6-30)

  1. All boxing contests and mixed martial arts contests are subject to the provision of this chapter. At least two

    (2) Commissioners shall be in attendance at every contest, and shall make a written report of that contest in accordance with Title 8, Part VI, Chapter 6·2, Section 40 (B).

  2. The Pascua Yaqui Athletic Commission (PYAC) may, upon invitation from another tribe or tribal entity, regulate a boxing or MMA event on behalf of such tribal entity for the purpose of promoting professionalism and safety in the sport.

SUBCHAPTER B PROFESSIONAL BOXING

Section 40 Imposition of Regulatory Fees, Reports to Tribal Council (8 PYTC § 6-6-40)

  1. Any person who promotes a boxing and martial arts contest under the jurisdiction of the Commission shall comply with regulations established pursuant to this chapter and shall prior to the start of the first bout on the day of the contest, pay to the Commission the fees according to the attached schedule, which is incorporated herein by reference: See Section 190-Table “A”.
  2. Within 30 days of each contest the Commission shall report to the Pascua Yaqui Tribal Council the total amount received pursuant to this chapter from regulatory fees and license fees, shall deposit it in the Pascua Yaqui Tribe general fund in a separate line item which shall comprise the entire operating budget of the Commission.

Section 50 Persons Required to Procure Licenses; Requirements; Background Information; Bond (8 PYTC § 6-6-50)

  1. All promoters, matchmakers, trainers, athletes, athlete’s managers and athlete’s seconds are required to be licensed by the Commission. The Commission shall not permit any of these persons to participate in the holding of any athlete contest unless the person has first procured a license.
  2. Before participating in the holding of any contest, a corporation, its officers and directors and any person holding twenty-five (25) percent or more of the ownership of the corporation, shall obtain a license from the Commission. Such a corporation must be authorized to do business under the laws of the State of Arizona or of the Pascua Yaqui Tribe.
  3. Before the Commission issues a license to a promoter, matchmaker or corporation, the applicant shall:
    1. Provide the Commission with the original executed contract between any athlete and the promoter which binds the promoter to pay the athlete according to the amount agreed upon in the contract.
    2. Identify all owners of the applicant entity and each owner’s percent interest, if that owner holds twenty-five (25) percent or more interest in the applicant entity.
    3. Provide the Commission with a copy of the latest financial statement of the entity, unless the entity is the Tribe or an enterprise of the Tribe.
    4. Provide the Commission with a copy of the insurance contract required by this chapter.
  4. Before the Commission issues a license to a promoter, the applicant shall deposit with the Commission a cash bond or surety bond in an amount set by the Commission. The bond shall be executed in favor of the Commission or the Pascua Yaqui Tribe and shall be conditioned on the faithful performance by the promoter of the promoter’s obligations pursuant to this chapter and the rules adopted pursuant to this chapter.
  5. Before the weigh-in, the applicant must have received medical clearance from the Commission and complete their pre-fight examination by the Ringside Physician. All requisite exams and forms are outlined in the Pascua Yaqui Athletic Commission Regulations.

Section 60 Promoters; Licenses; Bond; Proof of Financial Responsibility (8 PYTC § 6-6-60)

  1. The Commission may issue a license to conduct, hold or give boxing contests to any qualified person or to a corporation duly authorized to do business under the laws of the State of Arizona or of the Pascua Yaqui Tribe. The Commission may in its discretion withhold the granting of a license to a promoter until the applicant furnishes proof of his financial responsibility to promote boxing contests in accordance with this section and the rules adopted under this chapter.
  2. The promoter of each contest shall be responsible for paying all fees and expenses associated with the contest, including all fees charged by the Commissions and the fees and the expenses of the regulatory fee, drug testing fees, ringside physicians, ringside nurses, referees, judges, timekeepers, and inspectors. The promoter will be required to pay the required fees, prior to the start of the first bout on the day of the contest. In addition, the promoter will be responsible for providing the Commission with all requisite documentation to ensure proper payment of all fees and expenses due and owing. If a promoter defaults in paying the required fees and expenses, in whole or in part, the Commission may initiate administrative regulatory action against the

    promoter and/or commence a civil action to recover any fees or expenses owed. The exercise of one legal remedy by the Commission shall not preclude the exercise of other remedies.

  3. In addition to the surety bond required pursuant to Section 50(D), the Commission may require a promoter to deposit with the Commission prior to each contest a surety bond in an amount set by the Commission as a guarantee for the fulfillment of the promoter’s contract obligations for that boxing contest, the payment of licenses and taxes that may be imposed by the Tribe on gross receipts of that contest, and reimbursement to ticket purchasers if the contest is not held as advertised.

Section 70 License Fees; Expiration; Renewal (8 PYTC § 6-6-70)

  1. The Commission may establish and issue annual licenses, provided that the fees do not exceed the following amounts:
    1. Promoters, $200.00.
    2. Matchmakers, $100.00.
    3. Managers, $50.00.
    4. Athletes, athlete’s trainers and athlete’s seconds, $10.00
    5. For a corporation filing for a license to participate in the holding of any contest, $400.00.
    6. Officer, director or other person affiliated with a corporation, $50.00.
  2. A license expires December 31 at midnight in the year of its issuance and may be renewed on filing an application for renewal of a license with the Commission and payment of the license fee prescribed in Subsection (A). The application for renewal of a license shall be on a form provided by the Commission. There is a 30-day grace period during which a license may be renewed if a late filing penalty fee equal to the license fee is submitted with the regular license fee. A licensee that files late shall not conduct any activity regulated by this chapter until the Commission has renewed the license. If the licensee fails to apply to the Commission within the 30-day grace period, the licensee must apply for a new license pursuant to Subsection (A).

Section 80 Financial Interest in Boxer Prohibited (2 PYTC § 6-6-80)

A person shall not have, either directly or indirectly, any financial ownership interest in a boxer competing on premises owned or leased by the person, or in which the person is otherwise interested.

Section 90 Age of Participants (2 PYTC § 6-6·90)

A person under the age of eighteen (18) years shall not participate in any contest.

Section 100 Attendance of Medical and Emergency Personnel (2 PYTC § 6·6-100)

Every person holding or sponsoring any boxing contest shall have in attendance at every contest at least one (1) licensed physician, as well as an ambulance/paramedic unit, with the proper medical equipment, including resuscitation devices, at all times. The Commission may establish a schedule of fees to be paid to physicians and ambulance providers by the person or by the promoter.

Section 110 Insurance Coverage (8 PYTC § 6-6-110)

  1. The Commission shall:
    1. Require insurance coverage for an athlete to provide for medical, surgical and hospital care for injuries sustained in the fight area in an amount of $20,000 with $0 deductible and payable to the athlete as beneficiary.
    2. Require life insurance for an athlete in the amount of $50,000 payable in case of accidental death resulting from injuries sustained in the fight area.
  2. The cost of the insurance required by this section is payable by the promoter.

Section 120 Attendance by Peace Officers (8 PYTC § 6-6-120)

The Chief of the Pascua Yaqui Police Department shall have sole discretion on assignment of officers to prevent disturbances amounting to breach of the peace by spectators. The cost of providing the officer or officers shall be paid by the promoter.

Section 130 Disciplinary Action; Grounds; Emergency Suspension; Injunction (8 PYTC § 6·6·130)

  1. The Commission may take anyone or a combination of the following disciplinary actions:

    (l) Revoke a license.

    1. Suspend a license.
    2. Impose a civil penalty in an amount of not to exceed $5,000 per violation of this chapter.
  2. The Commission may take disciplinary action or refuse to issue or renew a license for any of the following causes:
    1. Committing an act involving dishonesty, fraud or deceit with the intent to substantially benefit oneself or another or substantially injure another.
    2. Advertising by means of known false, misleading, deceptive or fraudulent statements through any communication media.
    3. Violating any provision of this chapter or any rule adopted pursuant to this section.
    4. Making oral or written false statements to the Commission.
    5. Failing to complete the license application as prescribed by the Commission.
  3. In case of emergency, a member of the Commission may, on his own motion or on the verified complaint of any person charging a violation of this chapter or of the rules adopted under this chapter, suspend for a period of not to exceed ten (10) days any license until final determination by the Commission, if in his opinion the action is necessary to protect the public welfare and the best interests of the athlete.
  4. The Commission or the Attorney General of the Pascua Yaqui Tribe may apply to the Pascua Yaqui Tribal Court for an order enjoining the acts or practices of any person which constitute a violation of this chapter or the rules adopted pursuant to this chapter.

Section 140 Violation; Classification (8 PYTC § 6-6-140)

  1. A person has committed a civil violation who:
    1. Conducts, holds or gives boxing or mixed martial arts contests or participates in any boxing or mixed martial art contest without first having procured an appropriate license as prescribed in this chapter.
    2. Violates any provision of this chapter or any rule or regulation adopted pursuant to this chapter.
  2. A person found responsible for a violation under Subsection (A) of this Section shall be fined not more than

$5,000 for each violation.

Section 150 Selection of Officials (8 PYTC § 6-6-150)

The Commission shall select and assign officials. An athlete, matchmaker, or promoter may protest the assignment of officials only upon specific grounds submitted to the Commission in writing, (5) five days prior to the scheduled bout, and in such event the Commission shall select another official from a list of all officials licensed by the Tribe.

Section 160 Sham boxing; Withholding a Purse (8 PYTC § 6-6-160)

  1. The Commission may withhold all or part of a purse or other monies payable to any athlete, manager or second if in the judgment of the Commission an athlete is participating in a sham or fake contest or is otherwise not competing honestly or to the best of his ability.
  2. If the Commission withholds a purse or part of a purse or other monies the Commission shall give notice to all interested parties and hold a hearing upon the matter within (10) ten days.
  3. If the Commission determines that an athlete, manager or second is not entitled to a purse, part of a purse or other monies the promoter shall turn such monies over to the Commission.

Section 170 Judicial Review (8 PYTC § 6-6-170)

  1. Final decisions of the Commission are subject to judicial review in the Pascua Yaqui Tribal Court. Any person or entity desiring to appeal a final decision of the Commission must file an application for judicial review within fifteen (15) days after receiving notice from the Commission of its final decision.
  2. A person or entity aggrieved by a summary action taken by the Commission under Section 120(C) may seek an interlocutory review of the Commission’s action by filing an application for judicial review in the Pascua Yaqui Tribal Court. The application for judicial review must be filed within fifteen (15) days after receiving notice of the Commission’s action.
  3. The Pascua Yaqui Tribal Court shall decide all relevant questions of law or fact presented, interpret constitutional and statutory provisions, and determine the basis for the action of the Commission. The reviewing court shall uphold the action of the Commission unless the court determines that the Commission’s action was:
    1. Arbitrary, capricious, an abuse of discretion, or otherwise not in accordance with law;
    2. Contrary to constitutional right, power, privilege, or immunity;
    3. In excess of statutory jurisdiction, authority, or limitations, or in violation of statutory right;
    4. Without observance of procedure required by law; or
    5. Unsupported by substantial evidence.

Section 180 Reciprocity Tables (8 PYTC § 6-6-180)

  1. Notwithstanding Section 50, the Commission may waive the requirement for a license for any person or entity who complies with the requirements of each of the following:
    1. Submits to the Commission under oath an application for a license on a form supplied by the Commission.
    2. Is licensed by the Arizona State Boxing Commission.
    3. Pays the prescribed fees and expenses.

SUBCHAPTER C AMATEUR BOXING

Section 200 Amateur Boxing Contest and Exhibitions (8 PYTC § 6-6-200)

  1. The Commission will recognize an amateur boxing contest or exhibition only if it is registered and sanctioned by United States Amateur Boxing, Inc., or other organization acceptable to the Commission, as an amateur boxing contest or exhibition.
  2. An amateur boxing contest or exhibition shall be governed by the rules adopted for amateur boxing contests or exhibitions by United States Amateur Boxing, Inc. The Commission hereby adopts by reference those rules as they exist in the form most recently adopted by United States Amateur Boxing, Inc. If those rules do not cover a particular situation in an amateur boxing contest or exhibition, the provisions of this chapter concerning professional boxing contests or exhibitions shall apply.
  3. An amateur boxer may not take part in an amateur boxing contest or exhibition unless he or she is registered with United States Amateur Boxing, Inc., or some other amateur organization recognized by the Commission.

Section 210 Relations with Amateur Athletic Associations (8 PYTC § 6-6-210)

  1. The Commission may collaborate through the local amateur athletic associations in the conduct of amateur events under the jurisdiction of the Commission, at its discretion. At no time may the authority of the Commission or the responsibility of the Commission to enforce the Pascua Yaqui Tribal Code be relinquished, delegated or impaired, by or through the processes of collaboration.
  2. When the Commission collaborates with an amateur athletic association in the conduct of an amateur event, the rules and regulations of the amateur athletic association relating to weight classes, ring and ring equipment, conduct of contests and scoring system shall be in effect. However, if a controversy arises in connection with a subject which is not covered by the express provisions of this chapter, the Commission

will reserve the right to finally pass upon the matter and to make whatever decision it deems to be fair and equitable under the circumstances. The decision will be final.

Section 220 Safety at Events (8 PYTC § 6-6-220)

The promoter shall be responsible for the maintenance of order and the safety of persons present at each event under its sponsorship and it shall provide ample and effective police and fire protection at each event.

Section 230 Matchmakers (8 PYTC § 6-6-230)

  1. Matchmakers for amateur boxing events need not be licensed by the Commission, but their actions shall be subject to Commission approval.
  2. Matchmakers shall be familiar with the records, the abilities and the physical condition of the amateur boxers whom they propose to pair for bouts.

Section 240 Boxers (8 PYTC § 6-6-240)

  1. The Commission may suspend an amateur boxer who the Commission determines cannot safely defend himself or whose actions are deemed detrimental to the sport of boxing.
  2. Participants in amateur events under the jurisdiction of the Commission shall conform to the regulations set forth by the local amateur athletic associations.

Section 250 Seconds or Trainers (8 PYTC § 6-6-250)

  1. The Commission will permit amateur boxing seconds to function only after they have been approved by the local amateur athletic associations. However, the Commission may designate a second if no second approved by the amateur athletic associations is available.
  2. The Commission may remove a second who displays improper conduct in the course of an event.
  3. First aid and other ring equipment of a second shall in all cases and at all times, before, during and after use, be subject to inspection by the attending physician and Commission personnel. Any decision as to the propriety of its use shall be final.

Section 260 Referees (8 PYTC § 6-6-260)

  1. Amateur boxing referees shall be appointed by the amateur athletic associations with the approval of the Commission. Referees may be removed by a commissioner at any time if deemed incompetent.
  2. A referee appointed under this section shall be twenty-one (21) years of age or older, of good moral character and reputation, of sound physical health and approved by the amateur athletic association overseeing the event.
  3. The powers and duties of an amateur boxing referee shall be the same as those for professional boxing referees, except that the referee shall enforce the rules of amateur boxing as set forth in the Athletic Code and this part as well as those rules adopted and promulgated by the amateur athletic associations.
  4. The Commission will determine the amount of the compensation of amateur boxing referees in accordance with reason and equity in the circumstances of the respective events to which they are appointed, and the compensation shall be paid in full in each case by the sponsor of the event.

Section 270 Judges (8 PYTC § 6-6-270)

  1. An amateur boxing judge shall be appointed by the amateur athletic association with the approval of the Commission. A judge may be removed by a commissioner, the Executive Director or an inspector at any time if deemed incompetent.
  2. An amateur boxing judge shall be twenty-one (21) years of age or older, and of good moral character and reputation.
  3. It shall be the duty of an amateur boxing judge to observe carefully and expertly the performances of the boxers in each contest to which he is appointed and to appraise the performances fairly and accurately.

Section 280 Timekeepers (8 PYTC § 6-6-280)

  1. Timekeepers for amateur events may be appointed by the amateur athletic association with the approval of the Commission.
  2. The duties and responsibilities of timekeepers for amateur boxing events shall be the same as of timekeepers for professional contests.

Section 290 Insurance (8 PYTC § 6-6-290)

  1. The promoter of each amateur event shall ensure that all participants are covered by insurance. Costs associated with the insurance shall be the responsibility of the sponsor.
  2. Responsibilities with respect to the reporting, examination and investigation of injuries to amateur boxers shall be the same as those for professional boxers (relating to insurance). However, when the requirements of these subsections are violated by unlicensed persons, the delinquent persons shall be eligible for disbarment from further connection with amateur and professional events under the jurisdiction of the Commission.

Section 300 Age of Participation (8 PYTC § 6-6-300)

  1. A person between twelve (12) and seventeen (17) years of age may participate in amateur contests or exhibitions after obtaining written permission from a parent or legal guardian, and the consent of the Commission.
  2. A person twelve (12) to sixteen (16) years of age may not participate in a contest against an opponent who is more than one (1) year older.
  3. The limitations in subsections (a) and (b) do not apply to sanctioned events for the Junior Olympics under the direction of a National governing organization certified by the Commission.
    1. For the purposes of the Junior Olympic events, participants, with the written permission of a parent or legal guardian, may box only in the following age divisions:
      1. Ten (10) and eleven (11) years of age.
      2. Twelve (12) and thirteen (13) years of age.
      3. Fourteen (14) and fifteen (15) years of age.
    2. A participant may not take part in any event outside of the approved division for that “age group.”

SUBCHAPTER D PROFESSIONAL MIXED MARTIAL ARTS

Section 310 General Provision (8 PYTC § 6-6-310)

  1. The Pascua Yaqui Boxing Ordinance, as it relates to professional boxers, applies to amateur mixed martial arts competitors, promoters and other licensees, except as otherwise provided in this subchapter.
  2. A professional mixed martial arts contest or exhibition shall be governed by the rules adopted by the Association of the Boxing Commission and Combative Sports. The Commission herby adopts by reference the Unified Rules of Mixed Martial Arts as they exist in the form mostly recently adopted by the Association of Boxing Commissions and Combative Sports. If those rules do not cover a particular situation in an amateur boxing contest or exhibition, the provisions of the Pascua Yaqui Athletic Commission Mixed Martial Arts Regulations concerning professional mixed martial arts contests or exhibitions shall apply.

SUBCHAPTER E AMATUER MIXED MARTIAL ARTS

Section 320 General Provisions (8 PYTC § 6-6-320)

  1. The Pascua Yaqui Boxing Ordinance, as it relates to professional boxers, applies to amateur mixed martial arts competitors, promoters and other licensees, except as otherwise provided in this subchapter.
  2. A professional mixed martial arts contest or exhibition shall be governed by the rules adopted by the Association of the Boxing Commission and Combative Sports. The Commission herby adopts by reference the Unified Rules of Mixed Martial Arts as they exist in the form mostly recently adopted by the Association of Boxing Commissions and Combative Sports. If those rules do not cover a particular situation in an amateur boxing contest or exhibition, the provisions of the Pascua Yaqui Athletic Commission Mixed Martial Arts Regulations concerning professional mixed martial arts contests or exhibitions shall apply.
